OBJECTIVE: This paper addresses the question of the circumstances which lead clinicians to use legal coercion in the management of patients with severe anorexia nervosa, and explores similarities and differences between such formal coercion and other forms of 'strong persuasion' in patient management. METHOD: Logistic regression and other statistical analysis was undertaken on 75 first admissions for anorexia nervosa from a sample of 117 successive admissions to an eating disorder facility in New South Wales, Australia, where an eating disorder was (...) the primary diagnosis. Admissions with other primary diagnoses, such as bulimia nervosa (25 episodes), and entries with a co morbid diagnosis (e.g. depression or opiate overdose), were discarded, leaving 96 admissions by 75 individuals. RESULTS: Resort to measures of legal coercion into treatment was found to be associated with three main indicators: the patient's past history (number of previous admissions); the complexity of their condition (the number of other psychiatric co morbidities); and their current health risk (measured either by Body Mass Index or the risk of re-feeding syndrome). CONCLUSIONS: Our study is consistent with the few earlier studies about indicators for legal coercion in anorexia nervosa management, and suggests that clinicians use legal coercion very sparingly, distinguishing legal coercion from other forms of close clinical management of patients. Alvin Goldman’s contributions to contemporary epistemology are impressive—few epistemologists have provided others so many occasions for reflecting on the fundamental character of their discipline and its concepts. His work has informed the way epistemological questions have changed (and remained consistent) over the last two decades. We (the authors of this paper) can perhaps best suggest our indebtedness by noting that there is probably no paper on epistemology that either of us individually or jointly have produced that does not in its (...) notes and references bear clear testimony to the influence of Professor Goldman’s arguments. The present paper is no exception (and this would be a particularly inapt place to break with our tradition of indebtedness). Professor Goldman has produced a series of discussions that we find particularly important for coming to terms with the venerable idea that there may be truths that can be known a priori (Goldman 1992a, 1992b, 1999). We do not altogether follow his lead, while he draws on the idea that a priori justification has something to do with innateness or processess, we prefer to accentuate the idea that a priori justification turns on a conceptually grounded truths and access via acquired conceptual competence (at least in many significant philosophical cases). Still, in developing our understanding we have been aided by much that Professor Goldman says regarding concepts, conceptual competence, and related psychological processes. The influences should become progressively clear, particularly in the later sections of this paper. What would it take for there to be a priori knowledge or justification? We can begin by reflecting on a widely agreed on answer to this question—one that purports to identify something that would at least be adequate for a priori justification. The answer will then serve as one anchor for the present investigation, a bit of shared ground on which empiricists and rationalists can, and typically do, agree.. (shrink)

Recent calls have been made to move professional standards to a more principles-based perspective, supposing that emphasizing broad principles would eliminate the legalistic focus that rules may encourage, and accountants’ behavior would be more ethical and uniformly so. However, this supposition has yet to be empirically tested. The AICPA Code of Professional Conduct (Code) provides guidance in both forms: principles and rules. This experiment examines how the form of the Code affects independence judgments in a client acceptance context. We also (...) examine the potential for levels of moral development to influence the effectiveness of the Code.We find that subjects are more likely to consider their independence impaired, and are more likely to reject a questionable audit engagement, when rules-based (principles-based) reasoners are provided with Code rules (principles). Given the popularity of the view that rules-based standards are undesirable, these findings have significant implications for the profession as principles-based ethical standards are discussed. We propose an approach to epistemic justification that incorporates elements of both reliabilism and evidentialism, while also transforming these elements in significant ways. After briefly describing and motivating the non-standard version of reliabilism that Henderson and Horgan call “transglobal” reliabilism, we harness some of Henderson and Horgan’s conceptual machinery to provide a non-reliabilist account of propositional justification (i.e., evidential support). We then invoke this account, together with the notion of a transglobally reliable belief-forming process, to give an account of doxastic (...) justification. (shrink)

The authors argue in favor of the “nonconciliation” (or “steadfast”) position concerning the problem of peer disagreement. Throughout the paper they place heavy emphasis on matters of phenomenology—on how things seem epistemically with respect to the net import of one’s available evidence vis-à-vis the disputed claim p, and on how such phenomenology is affected by the awareness that an interlocutor whom one initially regards as an epistemic peer disagrees with oneself about p. Central to the argument is a nested goal/sub-goal (...) hierarchy that the authors claim is inherent to the structure of epistemically responsible belief-formation: pursuing true beliefs by pursuing beliefs that are objectively likely given one’s total available evidence; pursuing this sub-goal by pursuing beliefs that are likely true (given that evidence) relative to one’s own deep epistemic sensibility; and pursuing this sub-sub-goal by forming beliefs in accordance with one’s own all-in, ultima facie, epistemic seemings. This book builds on the idea that pragmatics and philosophy are strictly interconnected and that advances in one area will generate consequential advantages in the other area. The first part of the book, entitled ‘Theoretical Approaches to Philosophy of Language’, contains contributions by philosophers of language on connectives, intensional contexts, demonstratives, subsententials, and implicit indirect reports. The second part, ‘Pragmatics in Discourse’, presents contributions that are more empirically based or of a more applicative nature and that deal with the pragmatics (...) of discourse, argumentation, pragmatics and law, and context. The book presents perspectives which, generally, make most of the Gricean idea of the centrality of a speaker’s intention in attribution of meaning to utterances, whether one is interested in the level of sentence-like units or larger chunks of discourse. Drawing on diverse philosophical and theological perspectives, the contributors to this collection debate the character of international society, the authority of international law and institutions, and the demands of international justice.

We here propose an account of what it is for an agent to be objectively justified in holding some belief. We present in outline this approach, which we call transglobal reliabilism, and we discuss how it is motivated by various thought experiments. While transglobal reliabilism is an externalist epistemology, we think that it accommodates traditional internalist concerns and objections in a uniquely natural and respectful way.

Disagreement affords humans as members of epistemic communities important opportunities for refining or improving their epistemic situations with respect to many of their beliefs. To get such epistemic gains, one needs to explore and gauge one’s own epistemic situation and the epistemic situations of others. Accordingly, a fitting response to disagreement regarding some matter, p, typically will turn on the resolution of two strongly interrelated questions: (1) whether p, and (2) why one’s interlocutor disagrees with oneself about p. When one (...) has high intellectual respect for one’s interlocutor, answering question (2) involves arriving at a sympathetic explanatory understanding of the interlocutor’s own epistemic attitude toward p. Sorting out (2) is an abductive matter. Further, so far as the abductive explanation conditions one’s epistemic take regarding (1), there will be an abductive character to one’s epistemic position with respect to whether p—even where one’s initial purchase on whether p was not an abductive matter. In our work we have drawn attention to an aspect of conscious experience that we have labeled chromatic illumination, which consists of conscious appreciation of a large body of background information, and of the holistic relevance of this information to a cognitive task that is being consciously undertaken, without that information being represented by any conscious, occurrent, intentional mental state. We have also characterized the prototypical causal role of chromatic-illumination features of conscious intentional states, and we have detailed the specific (...) kind of physical-to-mental supervenience situation that would need to obtain in order for a chromatically illuminated conscious intentional state to figure as a supervenient mental cause of one’s subsequent cognition and behavior. In this paper we answer two residual questions. The first is a “How possible?” question, asking whether such a supervenience scenario is really a coherent conceptual possibility, given that it posits a putative conscious feature of conscious experience that allegedly plays a conscious causal role that supposedly constitutes conscious appreciation of information not being consciously represented. The second is a “How plausible?” question, asking whether the details of such a physical-to-mental supervenience scenario can be spelled out in a way that makes actually plausible the claim that chromatic illumination actually gets physically implemented this way in the human brain. We argue that the supervenient causal efficacy of chromatically illuminated conscious experience is not only a genuine conceptual possibility, but also very plausibly can really occur in humans. Eliminative materialism, as William Lycan (this volume) tells us, is materialism plus the claim that no creature has ever had a belief, desire, intention, hope, wish, or other “folk-psychological” state. Some contemporary philosophers claim that eliminative materialism is very likely true. They sketch certain potential scenarios, for the way theory might develop in cognitive science and neuroscience, that they claim are fairly likely; and they maintain that if such.

We argue that introspection reveals a ubiquitous aspect of conscious experience that hitherto has been largely unappreciated in philosophy of mind and in cognitive science: conscious appreciation of a large body of background information, and of the holistic relevance of this information to a cognitive task that is being consciously undertaken, without that information being represented by any conscious, occurrent, intentional mental state. We call this phenomenon chromatic illumination. We begin with a phenomenological case study, involving an experience of joke-understanding (...) in which the conscious aspect of chromatic illumination is especially vivid. Then we offer an account of the prototypical causal role of conscious intentional states, and we offer a contrasting account of the somewhat different prototypical causal role of conscious chromatic-illumination features of conscious intentional states. Finally, we describe the specific kind of physical-to-mental supervenience situation that needs to obtain in order for a chromatically illuminated conscious intentional state to figure as a supervenient mental cause that exerts both kinds of prototypical, content-appropriate, reasons-guidance vis-a-vis one’s cognition and behavior. This symposium provides five case studies of the ways that John Dewey's philosophy and practice were influenced by women or "weirdoes" (our choices include F. M. Alexander, Albert Barnes, Helen Bradford Thompson, Elsie Ripley Clapp, and Jane Addams) and presents some conclusions about the value of dialoging across difference for philosophers and other scholars.

Novice designers produced a sequence of sketches while inventing a logo for a novel brand of soft drink. The sketches were scored for the presence of specific objects, their local features and global composition. Self‐assessment scores for each sketch and art critics' scores for the end products were collected. It was investigated whether the design evolves in an essentially random fashion or according to an overall heuristic. The results indicated a macrostructure in the evolution of the design, characterized by two (...) stages. For the majority of participants, the first stage is marked by the introduction and modification of novel objects and their local and global aspects; the second stage is characterized by changes in their global composition. The minority that showed the better designs has a different strategy, in which most global changes were made in the beginning. Although participants did not consciously apply these strategies, their self‐assessment scores reflect the stages of the process. (shrink)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.
